Terms and Conditions

Welcome to Fudu. These Terms and Conditions (“Terms”) govern your access to and use of the Fudu mobile application (the “App”) available at fuduapp.com. The App is provided by Individual Entrepreneur Vladimir Dmitriev (“we,” “us,” “our,” or “Service Provider”) as a free service for users in the United States and beyond.
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any provision of these Terms, you must immediately discontinue use of the App and uninstall it from your device.
Intellectual Property Rights
All intellectual property rights in and to the App, including but not limited to trademarks, service marks, logos, copyrights, database rights, trade dress, and any other proprietary rights, are owned exclusively by the Service Provider. You are expressly prohibited from:
- Copying, reproducing, or duplicating any portion of the App
- Modifying, altering, or creating derivative works based on the App
- Reverse engineering, decompiling, or attempting to extract the source code
- Translating the App into other languages without authorization
- Using our trademarks, branding, or proprietary materials without written consent
Any unauthorized use of the App’s intellectual property may subject you to civil and criminal penalties under applicable U.S. federal and state laws.
License and Permitted Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial purposes on a mobile device that you own or control.
Service Modifications and Fees
We are committed to providing you with the best possible user experience. To achieve this goal, we reserve the right to modify, update, enhance, or discontinue any features or functionality of the App at any time, with or without prior notice. Such modifications may be implemented for any reason, including but not limited to improving performance, adding new features, or addressing security concerns.
While the App is currently offered as a free service, we may introduce subscription plans, premium features, or other paid services in the future. Should we elect to charge for any services, we will provide clear and transparent notice of all applicable fees, billing terms, and payment obligations before any charges are incurred. Your continued use of paid features will constitute acceptance of such charges.
User Responsibilities and Device Security
You are solely responsible for maintaining the confidentiality and security of your mobile device and your access credentials to the App. To protect your personal information and ensure optimal App performance, we strongly recommend that you:
- Keep your device’s operating system and security software up to date
- Use strong passwords and enable device authentication features
- Avoid jailbreaking (iOS) or rooting (Android) your device
Jailbreaking or rooting removes manufacturer-imposed security restrictions and may expose your device to malware, viruses, security vulnerabilities, and other malicious programs. Such modifications may cause the App to malfunction, become unstable, or cease functioning entirely. We cannot guarantee App performance or security on modified devices and disclaim all liability for issues arising from device modification.
Data Processing and Privacy
In order to provide you with our Service, the App collects, stores, and processes certain personal data that you provide. It is your responsibility to ensure that any information you submit is accurate, current, and complete. For detailed information about our data practices, please review our Privacy Policy, which is incorporated into these Terms by reference.
Third-Party Services
The App integrates certain third-party services to enhance functionality and user experience. These third-party providers operate under their own separate Terms and Conditions and Privacy Policies. We encourage you to review these policies carefully:
We are not responsible for the practices, policies, or content of these third-party service providers. Your use of third-party services through the App is at your own risk.
Internet Connectivity Requirements
Certain features of the App require an active internet connection, either through Wi-Fi or a mobile data network provided by your wireless carrier. We do not guarantee uninterrupted access to the App and cannot be held liable for:
- Service interruptions due to lack of Wi-Fi access
- Reduced functionality resulting from insufficient mobile data
- Inability to use the App when your data allowance has been exceeded
- Connection issues caused by your internet service provider or mobile carrier
Mobile Data and Roaming Charges
When you access the App using a mobile data connection, standard rates from your mobile network provider will apply. You are solely responsible for all data charges incurred while using the App, including but not limited to:
- Standard mobile data usage charges
- International roaming charges when using the App outside your home country or region
- Overage fees if you exceed your data plan limits
- Any other fees imposed by your mobile carrier
If you are not the account holder or primary bill payer for the device on which you use the App, you represent and warrant that you have obtained the account holder’s permission to incur such charges. We assume no responsibility for charges incurred without proper authorization.
Device Battery and Maintenance
You acknowledge that the App may consume battery power and device resources. You are responsible for ensuring that your device remains adequately charged to access the Service. We cannot be held liable if you are unable to use the App due to insufficient battery power or device malfunction.
Limitations of Liability
While we make every reasonable effort to ensure that the App is accurate, reliable, and up-to-date, we rely on information provided by third parties and cannot guarantee the completeness or accuracy of all content. The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied.
To the maximum extent permitted by applicable law, we disclaim all liability for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to:
- Your use of or inability to use the App
- Any errors, omissions, or inaccuracies in the App’s content
- Reliance on information obtained through the App
- Unauthorized access to your personal data
- Interruption or cessation of the Service
- Any other matter relating to the App
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability shall be limited to the fullest extent permitted by law.
App Updates and Compatibility
From time to time, we may release updates, upgrades, patches, or new versions of the App to improve functionality, fix bugs, enhance security, or add new features. The App’s availability and compatibility are based on the requirements of your device’s operating system (iOS, Android, or other platforms we may support).
To continue using the App, you may be required to download and install updates when they become available. While we strive to maintain compatibility with current operating system versions, we do not guarantee that the App will always be compatible with your specific device or OS version. You agree to accept all updates when offered.
We reserve the right to discontinue support for older operating system versions or device models at our discretion.
Termination of Service
We may, at our sole discretion, terminate, suspend, or discontinue the App or your access to it at any time, for any reason, with or without prior notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms
- Fraudulent or illegal activity
- Business considerations or operational changes
- Extended periods of inactivity
Upon termination of the Service or your access rights:
- All rights and licenses granted to you under these Terms will immediately cease
- You must immediately stop using the App and uninstall it from all devices
- Provisions of these Terms that by their nature should survive termination shall remain in effect
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which the Service Provider is domiciled, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for resolution of any disputes arising under these Terms.
Indemnification
You agree to indemnify, defend, and hold harmless the Service Provider, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the App, constitute the entire agreement between you and the Service Provider regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.
Changes and Updates to These Terms
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. When we make changes, we will update the “Effective Date” at the top of this page and post the revised Terms on this page and within the App.
We encourage you to review these Terms periodically to stay informed of any updates. Material changes may be communicated through in-app notifications, email, or other prominent notices. Your continued use of the App after the posting of revised Terms constitutes your acceptance of such changes.
